1. Acceptance of terms

These Terms apply to every visitor, registered user, and customer of the Platform. We may update these Terms from time to time as described in Section 12; continued use of the Platform after an update constitutes acceptance of the revised Terms.

2. Eligibility & account

You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872 to create a ZipyGo account. Ordering any product from the alcohol category additionally requires you to be at least 21 years old and to complete ZipyGo's age-verification process (see Section 5).

Accounts are created and accessed using your mobile number and a one-time password (OTP) sent by SMS. You are responsible for keeping your device and mobile number secure, and for all activity that occurs under your account. Notify us immediately at the contact details in Section 10 if you suspect unauthorised use of your account.

3. Orders, pricing & payments

Placing an order through the Platform is an offer by you to purchase the selected products, which ZipyGo (or the fulfilling dark store) may accept or decline. A contract of sale is formed only once your order is confirmed and accepted.

Product prices, availability, and delivery fees are displayed at the time of ordering and may change without prior notice; the price and delivery fee shown at checkout is the price you pay for that order. All prices are inclusive of applicable taxes unless stated otherwise.

Online payments are processed through our third-party payment gateway partner using industry-standard encryption; ZipyGo does not store your card, UPI, or net-banking credentials. Cash on Delivery (COD) may be available in select areas at ZipyGo's discretion, and is not available for alcohol orders.

4. Delivery

ZipyGo fulfils orders from the nearest serviceable dark store to your delivery address. Estimated delivery times shown in the app (e.g. "9 minutes") are good-faith estimates based on distance, traffic, weather, and order volume, and are not a guaranteed delivery commitment. Delivery is currently available only within pincodes actively served by a ZipyGo dark store.

5. Alcohol & excise compliance

The alcohol/wine & spirits category is offered only where ZipyGo holds a valid, active excise license for the fulfilling dark store and the delivery address falls within a legally permitted zone. This category is hidden and unavailable everywhere else.

• You must be at least 21 years of age and complete ZipyGo's age-verification process (date of birth plus a valid government-issued photo ID) before placing an alcohol order.
• A ZipyGo delivery partner will verify your government ID again at the doorstep before handing over an alcohol order. We reserve the right to refuse delivery, without refund liability beyond the value of the refused item, if valid ID cannot be produced, if the recipient appears intoxicated, or if the recipient appears to be someone other than the verified account holder.
• Alcohol orders are not fulfilled on declared dry days or outside the delivery hours permitted by the applicable state excise authority, as configured in the app.
• Resale of alcohol purchased through ZipyGo is strictly prohibited.
• Alcohol orders are non-returnable and non-refundable once successfully delivered, except where the item delivered was damaged, incorrect, or tampered with — see our Refund & Cancellation Policy.

6. Cancellations by ZipyGo

We may cancel or refuse an order, in whole or in part, in circumstances including but not limited to: the ordered product becoming unavailable after the order was placed, an inability to verify age or identity for an alcohol order, suspected fraudulent or abusive use of the Platform, an undeliverable address, or events outside our reasonable control. In such cases, any amount already paid for the cancelled portion will be refunded as described in our Refund & Cancellation Policy.

7. User conduct

You agree not to:

• Use the Platform for any unlawful purpose, including attempting to obtain alcohol while underage or on behalf of an underage person;
• Provide false identity, age, or address information;
• Interfere with, disrupt, or attempt to gain unauthorised access to the Platform or its underlying systems;
• Abuse promotional offers, coupons, or referral programmes; or
• Harass, threaten, or behave abusively towards ZipyGo staff or delivery partners.

We may suspend or terminate accounts that violate these Terms, without prejudice to any other remedy available to us.

8. Intellectual property

The ZipyGo name, logo, app, website design, and all associated content are the property of Robosol India or its licensors and are protected under applicable intellectual property laws. You may not copy, reproduce, or create derivative works from the Platform without our prior written consent.

9. Liability & indemnity

To the maximum extent permitted by law, ZipyGo's aggregate liability arising from or relating to any order shall not exceed the value of that order. ZipyGo is not liable for indirect, incidental, or consequential losses, or for delays or failures caused by circumstances beyond our reasonable control. You agree to indemnify ZipyGo against claims arising from your breach of these Terms or misuse of the Platform, including any misuse relating to the alcohol category.

10. Grievance redressal

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the details of our Grievance Officer are provided below. We aim to acknowledge complaints within 24 hours and resolve them within 15 days of receipt.

11. Governing law & jurisdiction

These Terms are governed by the laws of India. Subject to Section 10, any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts at Kolkata, West Bengal.

12. Changes to these terms

We may revise these Terms from time to time to reflect changes in our services or applicable law. The "Last updated" date at the top of this page indicates when these Terms were last revised. Material changes will be highlighted in the app or on the website.
